They are published in compliance with the Consumer Rights Act 2015 and the Unfair Contract Terms Act 1977.
1. Who operates this Website
This Website is operated by Liberty Dreams LTD, a private company limited by shares, registered in England and Wales under company number 12724306 (VAT GB353810900), with registered office at Carpenter Court, 1 Maple Road, Bramhall, Stockport SK7 2DH, United Kingdom. References to “we”, “us” and “our” refer to Liberty Dreams LTD.
2. Acceptance of these terms
By accessing or using this Website, or by purchasing any service described in it, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Website or purchase any service through it.
3. Permitted use of this Website
You agree to use this Website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Website. You agree not to:
- Use the Website in any way that violates applicable law.
- Attempt to gain unauthorised access to any part of the Website or to its infrastructure.
- Use the Website to transmit malicious code or to interfere with its operation.
4. Hosting services (terms of service)
Some services accessible through this Website are the hosting services offered at libertydreams.co.uk/hosting-services/ (the “Hosting Services”). This section 4 contains the specific terms applicable to the Hosting Services. Where the Hosting Services are concerned, these terms form the service agreement between Liberty Dreams LTD and the customer purchasing the Hosting Services.
4.1. Description of the Hosting Services
Liberty Dreams LTD provides shared web hosting services (the “Hosting Services”) marketed under two principal plans (Simple Hosting and Companion Hosting, jointly the “Plans”). The Hosting Services consist of:
- Allocation of shared hosting space on servers located in the United Kingdom.
- Operating system and basic software stack managed by Liberty Dreams LTD through a technology partner (the hosting reseller).
- A control panel for the customer to manage their web space, email accounts and databases.
- Bandwidth and storage allocation according to the Plan subscribed.
The exact specifications, allocation and pricing of each Plan are described on the page libertydreams.co.uk/hosting-services/ at the moment of purchase. The specifications published there form part of these terms.
4.2. Reseller arrangement and exclusion of certain warranties
The Hosting Services are operated through a third-party reseller and infrastructure partner. Liberty Dreams LTD acts as the contractual counterparty of the customer and assumes direct responsibility for the operation of the customer relationship. The underlying infrastructure is operated by a technology partner; Liberty Dreams LTD passes through to the customer, up to the limit of what the technology partner makes available to it, such service-level warranties as the technology partner offers.
To the extent permitted by applicable law, the Hosting Services are provided on an “as-is” and “as-available” basis, and Liberty Dreams LTD does not warrant that the Hosting Services will be uninterrupted, error-free or free from security incidents beyond its reasonable control.
4.3. Customer obligations
The customer agrees to:
- Use the Hosting Services within the allocation of the subscribed Plan.
- Not use the Hosting Services to host content that is unlawful under the laws of England and Wales or that infringes third-party intellectual property rights.
- Not use the Hosting Services to send unsolicited bulk email, host malware, distribute illegal content, or engage in phishing or other fraudulent activity.
- Keep their account credentials confidential.
Liberty Dreams LTD may suspend the Hosting Services in the event of a material breach by the customer, after a reasonable notice where possible, particularly where suspension is necessary to protect the integrity of the infrastructure or to comply with applicable law.
4.4. Term, renewal and cancellation
The Hosting Services are offered on a recurring subscription basis (monthly or annual, as selected at purchase). The subscription is renewed automatically for successive periods of equal duration, unless the customer cancels before the renewal date.
The customer may cancel the Hosting Services at any time, with effect at the end of the current billing period, through the customer control panel or by notice to tickets@libertydreams.co.uk.
Liberty Dreams LTD may terminate or suspend the Hosting Services for material breach, including non-payment, with reasonable notice where possible.
4.5. Fees and refunds
The fees for the Hosting Services are published on libertydreams.co.uk/hosting-services/ and are payable in advance for the chosen billing period. Fees are stated in pounds sterling (GBP) by default. Where the customer chooses an alternative currency at checkout (such as EUR or USD), the fee is charged in that currency and converted by our payment processor. Currency conversion fees, where applicable, are charged by the payment processor and not by Liberty Dreams LTD.
If the customer cancels within fourteen (14) calendar days of first activation of a new Plan and the customer has not substantially used the Hosting Services in that period, Liberty Dreams LTD will refund the fees paid for the current billing period, less any usage-based charges already incurred. This right is in addition to the consumer rights granted by the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (S.I. 2013/3133) where applicable. After the fourteen-day period, fees paid for the current period are not refundable except where required by applicable law.
4.6. Service availability and support
Liberty Dreams LTD will use reasonable endeavours to keep the Hosting Services available and to respond to support requests within a reasonable timeframe. The hosting infrastructure is operated through a third-party reseller, and Liberty Dreams LTD does not guarantee a specific uptime percentage beyond what its technology partner makes available to it.
Support is handled exclusively through tickets@libertydreams.co.uk. Liberty Dreams LTD does not provide telephone support for the Hosting Services.
4.6bis. Force majeure
Liberty Dreams LTD is not liable for any failure or delay in the performance of the Hosting Services caused by events beyond its reasonable control, including but not limited to: failures of upstream Internet providers, denial-of-service attacks, cyber attacks on the infrastructure of the technology partner, natural disasters, pandemic-related restrictions, government orders, civil unrest, war, or labour disputes. Performance is excused for the duration of the force majeure event. Where the force majeure event continues for more than thirty (30) consecutive days, the customer may terminate the Hosting Services with a pro-rata refund of fees paid for the unused portion of the current billing period.
4.6ter. Data return and deletion on cancellation
Upon cancellation of the Hosting Services (whether by the customer or by Liberty Dreams LTD), the customer is responsible for retrieving their data (files, email messages, databases) from the control panel within thirty (30) calendar days following the effective date of cancellation. After this thirty-day period, Liberty Dreams LTD will delete the customer’s data from the production infrastructure and from routine backups, except where retention is required to comply with applicable law (for example, tax or accounting obligations). Routine backup cycles may retain residual copies for up to ninety (90) days after cancellation; these residual copies are not accessible to the customer and are deleted in the ordinary course of the backup rotation. The customer may request earlier deletion of their data in writing to tickets@libertydreams.co.uk.
4.7 Acceptable use of the Hosting Services
In addition to the legal prohibitions set out in section 4.3, the customer may not use the Hosting Services for any of the following activities, whether on the customer’s own web space or on web space offered to third parties through the customer’s account:
- Bulk file, media or streaming services: using the Hosting Services as a bulk file-sharing, media-sharing or streaming platform, including any free or paid distribution of the same set of files or media to a wide audience. Sharing individually curated sets with named customers (for example, a photographer delivering images to clients) is permitted.
- Bulk backup or archival storage: using the Hosting Services as a primary storage for files, mail or media held for backup or archival reasons. Files older than seven (7) days may be removed where they exceed reasonable use.
- Personal cloud or office platforms: hosting personal cloud or office applications (such as OwnCloud or NextCloud) on the Hosting Services is not permitted.
- Open SMTP relay: operating an open SMTP relay, or sending unsolicited bulk email. Sending bulk email for legitimate purposes (transactional email, opt-in marketing to the customer’s own customers) must be carried out through a transactional email provider, not through the Hosting Services.
- Hosting for third parties: providing free hosting to third parties on plans that are not reseller plans, or providing paid hosting without using an appropriate reseller plan.
- Harmful content or activity: any content or activity that breaches applicable law, that is unlawful, fraudulent, dishonest, defamatory, obscene, pornographic, sexually explicit, discriminatory, deceptive, threatening, offensive, harassing or invasive of privacy, or that promotes violence or discrimination on the basis of race, sex, religion, nationality, disability, sexual orientation or age.
- Security abuse: attempting to gain unauthorised access to computers, data, systems, accounts or networks of any person; transmitting viruses, ransomware, spyware, adware or any other harmful code; or initiating any denial-of-service or similar attack.
- Phishing or impersonation: impersonating any other person, service or entity in order to collect identity information, authentication credentials or other personal data.
- Misrepresentation: representing that the customer is associated with, or endorsed by, Liberty Dreams LTD or by the technology partner where this is not the case.
The customer is responsible for all activity originating from their account. Liberty Dreams LTD may suspend or terminate the Hosting Services for any material breach of this section 4.7, after reasonable notice where possible, particularly where suspension is necessary to protect the integrity of the infrastructure or to comply with applicable law.
The communication standards described in this section apply to any data, information or communication made on or using the Hosting Services by the customer or by any third party hosted by the customer.
5. Intellectual property
All content on this Website is the property of Liberty Dreams LTD or its licensors. See the Legal Notice for details.
6. Limitation of liability
To the maximum extent permitted by applicable law, Liberty Dreams LTD is not liable for any indirect, incidental, consequential or special damage arising from your use of this Website or of the Hosting Services.
Nothing in these Terms and Conditions shall exclude or limit liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under the Unfair Contract Terms Act 1977, the Consumer Rights Act 2015 or any other applicable law.
7. Third-party links
This Website contains links to third-party websites. Liberty Dreams LTD does not endorse and is not responsible for the content or practices of such websites.
8. Changes to these terms
We may update these Terms and Conditions from time to time. The “last updated” date at the top of this document reflects when the latest change was made. Where changes are material — in particular where they affect the Hosting Services or the customer’s contractual position — we will give the customer reasonable advance notice, of at least thirty (30) days, by email to the address associated with the customer’s account and by notice on this Website.
The customer’s continued use of the Hosting Services after the end of the notice period constitutes acceptance of the updated terms. Where a customer does not agree with the updated terms, they may cancel the Hosting Services in accordance with section 4.4 and receive a pro-rata refund for any unused portion of the current billing period.
Applicable law and jurisdiction
These terms are governed by the laws of England and Wales. For any dispute arising from the use of this Website, the parties expressly submit to the exclusive jurisdiction of the courts of England and Wales.
